The new mechanism should ensure that the aggressor state is held accountable and compensates for the damage caused to the state, citizens and legal entities.

 

The decision was adopted unanimously, with 84 votes.

 

"russia must bear the legal consequences of all its illegal actions committed in Ukraine and against Ukraine, including violations of international humanitarian law and human rights, as well as violations of the European Convention on Human Rights. russia is obliged to fully compensate for all damages and losses caused to the Ukrainian state, individuals and legal entities," the document states.

 

The Commission for the Consideration of Claims will be the second element of the compensation mechanism, after the Register of Damages, which has already received more than 60,000 claims from victims.

 

The new instrument will allow not only Ukraine as a state, but also individuals and legal entities to file claims for damages caused by the russian federation's aggression. The Commission's decisions will be final and will form the legal basis for compensation.

 

The Commission will complement the work of the European Court of Human Rights and the future Special Tribunal for the Crime of Aggression. The importance of the independence and impartiality of the newly created body is emphasised separately.

 

At the same time, PACE expressed regret that the issue of financing future compensation has not yet been clearly resolved. The Assembly called on member states to work on the creation of an international compensation fund, in particular from frozen russian assets.

 

The conclusion also stresses that the time frame of the future commission should not be limited to events after 24 February 2022. ‘The Assembly has always considered that the russian federation's war of aggression against Ukraine began on 20 February 2014,’ the document emphasises.

 

The Parliamentary Assembly called on the Committee of Ministers of the Council of Europe to adopt the convention as soon as possible and open it for signature in order to ensure the effective functioning of the compensation mechanism for Ukraine.

 

The Chairman of the Verkhovna Rada of Ukraine, Ruslan Stefanchuk, thanked PACE for adopting the conclusion on the draft convention on the establishment of an international commission to examine claims against Ukraine.

 

On 22 October, the Committee of Ministers of the Council of Europe is expected to approve the text of the Convention. On 16 December, the Council of Europe and the Netherlands are expected to convene a diplomatic conference to adopt the Convention and open it for signature by other states.
