“On November 13, 2024, the Second Senate began consideration of the case on the constitutional complaint of AEROC Investment Deutschland GmbH in the open part of the plenary session in the form of written proceedings,” the statement said.
As noted, the court is challenging a number of provisions of the Law on Sanctions, in particular the blocking of assets and the recovery of assets for the state.
The judge-rapporteur in this case, Oleg Pervomaisky, said that in 2023, the Ministry of Justice filed a lawsuit with the High Anti-Corruption Court against LSR Group PJSC with the participation of third parties who do not make independent claims regarding the subject matter of the dispute, on the side of the defendant - the company, russian citizen Andrey Yurievich Molchanov, AEROK LLC, with a request to in particular, to impose on LSR Group PJSC the sanction set forth in paragraph 11 of part one of Article 4 of Law No. 1644 and to recover assets for the benefit of the state, namely 100% of the share of the authorized capital of Aeroc LLC in the amount determined by the authorized capital held by the company, in respect of which LSR Group PJSC exercises rights identical in content to the right of disposal.
The HACC upheld the claim of the Ministry of Justice and recovered 100% of the share of the authorized capital of Aerok LLC for the state.
This decision was confirmed by the HACC Appeals Chamber.
The Constitutional Court examined the case file and proceeded to the closed part of the plenary session to make a decision.
As a reminder, AEROC LLC is a producer of autoclaved concrete in Ukraine and a supplier of autoclaved cellular concrete products under the AEROC trademark. The company is founded by a non-resident company Aeroc Investment Deutschland GmbH (Germany).
The State Bureau of Investigation found that an enterprise that manufactures concrete and aerated concrete products and supplies concrete structures for the construction of residential and industrial facilities operates in Kyiv region. The ultimate owner of this enterprise is a russian citizen who is a member of the inner circle of the russian President.
According to the SBI, the Obukhiv-based Aerok company is part of the russian construction group LSR, which is controlled by russian oligarch Andrey Molchanov.
Aerok's assets were seized and transferred to the ARMA in June 2022. In January 2023, ARMA selected a manager for the company's assets. It was Kharkiv Building Materials, a company that, like Aeroc, specializes in the production of aerated concrete, as well as bricks, gas blocks, concrete and other building materials.
