Sanctions against oligarch Serhiy Kurchenko confirmed as legitimate

The decision of the court of first instance, which has now been confirmed by the Court of Appeal, dismissed Sergiy Kurchenko's claim, confirming the legality of the Presidential Decree.

 

The court proceedings concerned Kurchenko's appeal against the Presidential Decree, which put into effect the decision of the National Security and Defense Council of Ukraine (NSDC) to impose a 10-year asset freeze on him. The grounds for this were, in particular, actions that pose real or potential threats to the national security of Ukraine, as well as involvement in facilitating terrorist activities, including after the full-scale invasion of Ukraine by russia.

 

This case is important for the practice of applying sanctions in Ukraine, especially in the context of russia's armed aggression. Despite the attempts of russian supporters to challenge the sanctions, the Presidential Office and lawyers of the Ministry of Justice of Ukraine, acting in the interests of the Government, continue to effectively protect the state interests in the legal field.

 

Earlier, on November 13, 2024, the Administrative Court of Cassation of the Supreme Court dismissed Kurchenko's claim in case No. 990/36/23, finally confirming the legality of the Decree of the President of Ukraine No. 694/2022 of 12.10.2022, which imposed personal sanctions on him. The decision of the court of first instance was upheld.
